Terms of Service

1. Agreement to Terms
By accessing or using the PicChase website (picchase.app) or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of the Service, including game hosts, players, and visitors to the website.
2. Description of Service
PicChase is a real-time multiplayer photo scavenger hunt game. A host creates a game session, shares a game code with other players, and participants race to photograph items from a challenge list. The Service is available as a mobile app for iOS and Android.
No account or registration is required to play. Players enter only a display name at the start of each game session.
3. Free and Premium Tiers
PicChase is free to download and use, subject to the following limitations:
Free Tier
- Up to 6 players per game
- Access to standard challenge packs
- Game data retained for 24 hours after the game ends, then permanently deleted
Premium Tier
- Unlimited players per game
- Access to all challenge packs, including exclusive Premium packs
- Game data retained for 14 days after the game ends, then permanently deleted
Premium features are available via an in-app purchase or subscription processed through Apple App Store or Google Play, subject to their respective terms and payment policies. All fees are non-refundable except as required by applicable law or as provided by the relevant app store's refund policy.
4. User Content
"User Content" means any photos, display names, or other content submitted by you through the Service during a game session.
Licence Grant
By submitting User Content, you grant PicChase a limited, temporary, non-exclusive licence to store, transmit, and display that content solely for the purpose of operating the game session. This licence expires when the game data is deleted (within 24 hours for free games; within 7 days for Premium games).
Your Responsibility
You are solely responsible for the User Content you submit. You must not submit content that:
- Is unlawful, harmful, threatening, abusive, harassing, or defamatory
- Infringes any third-party intellectual property, privacy, or other rights
- Contains nudity, sexually explicit material, or graphic violence
- Depicts or encourages illegal activity
- Involves photographs of individuals taken without their consent
We reserve the right to remove content that violates these Terms.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or tamper with the app or its infrastructure
- Disrupt or interfere with the Service's operation, servers, or networks
- Use automated scripts or bots to interact with the Service
- Use the Service in a way that could harm, endanger, or harass other players or third parties
- Attempt to gain unauthorised access to other users' game sessions
6. Intellectual Property
All content in the Service that is not User Content — including the app design, graphics, illustrations, challenge lists, text, and software — is owned by or licensed to PicChase and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written permission.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
8. Safety and Real-World Activity
PicChase is a real-world scavenger hunt game. You acknowledge that participating in the game requires physical movement and photography in real-world environments. You are solely responsible for your own safety and the safety of those around you while playing. PicChase is not liable for any injury, accident, loss, or damage arising from your physical participation in a game.
Always be aware of your surroundings. Do not trespass, endanger yourself or others, or break any laws in pursuit of a game item.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any defects in the Service will be corrected.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PICCHASE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY — ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability for any claims relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) €10 EUR.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless PicChase and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
12. Third-Party Services
The Service integrates with third-party services including Google Firebase, Google Analytics, and Crashlytics. Your use of those services is subject to their respective terms and policies. We are not responsible for the practices of any third-party service.
13. Termination
We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including violation of these Terms, without notice or liability. Upon termination, all licences granted to you under these Terms will immediately cease.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If a change is material, we will make reasonable efforts to notify users via the app or website.
15. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts. If you are a consumer in the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence.
